Prior notification of international transfers: publication of the decree

The Official Gazette (no. 252) Decree No. 136 dated 10 August 2016 and published 27 October 2016 relates to prior communication of international transfers. The regulation will enter into force as of December 27, 2016.

The decree defines the rules for the electronic filing of notices required by the “service providers” in the Ministry of Labour and Social Policy posting workers in Italy.

Under the Decree:

  • The “service” provider is the company established in another Member State or in a third country or an agency of labour administration established in another Member State which post workers in Italy;
  • The “transfer subject” is the company established in Italy or another recipient employing posted workers;
  • The “UNI_Distacco_UE” is the model by which the “service provider” fulfills the communication requirements of Article. 10 of Legislative Decree n. 136 of 2016.

The provider of services, within 24 hours of the day before the start of the secondment, must send a communication that can be cancelled within 24 hours of the day before the start of the first term of posting.

Any subsequent change must be sent within 5 days of the amending event. This requirement also applies to administration agencies through the UNI_Distacco_UE model.

The updated UNI_Distacco_UE model is already available on the website of the Ministry of Labour and Social Policy.

The data inserted will be made available to the National Labour Inspectorate, INPS and INAIL.
